1. Definitions
- “Supplier”, “We”, “Us”, “Our” refers to Quality Workwear Direct, trading under Magic Rainbow Studio (ABN [Your ABN])
- “Customer”, “You”, “Your” refers to the person or business placing an order with Us
- “Goods” means the products supplied via our website
- “Monies Due” includes purchase price, delivery/freight, packing, GST, and related charges
2. Acceptance of Terms
These Terms and Conditions govern your purchase of Goods from our website. By placing an order you agree to these Terms. Any additional terms you propose are void unless agreed in writing by Us.
3. Orders & Acceptance
- Orders are processed once full payment is received.
- We reserve the right to accept or reject any order, at our discretion (e.g. stock availability, pricing error).
- In case of missing or incorrect items, we will either back-order, replace or refund the unit price of the item at our discretion.
4. Prices & Payment
- Prices are subject to change without notice.
- Payment must be made in full before dispatch (unless credit terms have been agreed).
- If you pay by credit card, you warrant you are authorized to use it.
5. Risk & Title
- Risk in the Goods passes to You upon dispatch from our premises.
- Title (ownership) passes to You only once full payment is received (including all amounts due). Until then, Goods are held by You as bailee.
6. Delivery & Turnaround Time
- We endeavour to dispatch orders in a timely manner, but delay is not grounds for cancellation or liability.
- Delivery may occur in multiple shipments.
- For decorated/custom orders, extra time for artwork preparation may apply.
7. Returns, Exchanges & Faulty Goods
- Faulty or incorrect items must be notified to Us within a certain time (e.g. within 3 days).
- Customised items (e.g. printed, embroidered) generally cannot be returned unless faulty.
- For change-of-mind returns, we may charge a restocking fee, and shipping is at Customer’s expense.
- Goods must be returned in original condition, tags attached, etc.
8. Limitation of Liability
To the fullest extent permitted by law:
- We exclude or limit liability for indirect, special or consequential loss.
- Our total liability is capped at the purchase price of the Goods ordered.
- Nothing in these Terms is intended to exclude your rights under the Australian Consumer Law (e.g. for major failures).
9. Intellectual Property
- All content on our website (texts, images, logos) is owned or licensed by Us.
- You may not reproduce or use any content without Our consent.
10. Force Majeure
We are not liable for delays or failures resulting from causes beyond Our control (e.g. natural disaster, shipping delays, strikes).
11. Privacy & Data
Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and store your personal data.
12. Changes to Terms
We may update or change these Terms at any time. The version published on the website is the current one and applies to all orders from that date.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia (or whichever state your business is based). You agree to the non-exclusive jurisdiction of Victorian courts.
